Terms and Condition
TERMS: Terms of payment are 10 days from the date of delivery, service call, repairs, maintenance & other charges. (Safety cover installation and major equipment a 50% deposit is required and balance due on the day of installation) If a past due balance remains on your account InfiniteBlu Pool Service will make one courtesy attempt to contact you via all phone numbers on file. InfiniteBlu Pool Service is then hereby authorized to charge the credit card supplied on top of this contract or any other credit card on file for the past due amount including any incidental charges. A statement will be provided monthly if a balance is present
FINANCE CHARGES: Finance Charges are made on any balances past due according to the following method: (a)Using the unpaid balance of your account at the end of the billing period, we multiply this amount by the following monthly periodic rate: 1-1/2% of the balance, which is an ANNUAL PERCENTAGE RATE OF 18%.
COLLECTION COSTS: If amounts are not paid as agreed, we may demand immediate payment of the full balance. If the balance is referred to a collection agency or attorney for collection, you agree to pay a
fee of 33-1/3% of the total balance due plus any court costs.
IRREGULAR PAYMENT OR DELAY IN ENFORCEMENT: Acceptance of late payments or partial payments, checks or money orders marked “payment in full” or other statements indicating settlement of your account will not affect any of our rights under this agreement. Further, any delay on our part in enforcing our rights under this agreement will not affect those rights.
CHANGES OR AMENDMENTS: Changes to this agreement, including payment terms can be made by us as well as amendments this agreement, at any time, provided we give you at least 30 days notice before the beginning of the billing period in which the change or amendment becomes effective.
CANCELLATION: Either we or you can cancel your account any time by providing 30 days written notice. You agree to remain responsible for total payment for all purchases made prior to the expiration of the 30 days notice. Failure to provide written notice within 30 days of the date of service will result in a voluntary forfeit of your deposit. We reserve the right to cancel your account without notice if you do not make payment as agreed.
LIABILITY: We are not responsible for any damage or loss caused by failure to make delivery or repair due to labor shortage, strikes, manufacturer’s failure to deliver or any condition beyond our control. In the event of non-payment, and we do not deliver or repair as a result of non-payment, we will not be liable for any damages in either a direct or indirect manner. If diagnostic repairs are declined by customer, cleaning and disassembly charges on the bottom of this page will still apply.
POOL COVER STORAGE SERVICES TERMS & CONDITIONS: Thorough washing with an anti-microbial solution that prevents fungal/bacterial growth and eliminate odors. Inspection for wear, tears, holes, and more. Up to three holes patched at no charge up to 2” in length or diameter. Any additional holes will be patched upon inspection for an additional fee. In the event that your cover must be sent to the manufacturer for repair, we will notify you and obtain your authorization first. This service is primarily designed for safety pool covers, but we’ll store any reasonable pool cover. This service is developed, designed and offered as a convenience for our valued customers. InfiniteBlu Pool Service does not responsibility for pre-existing wears, tears, or holes in the cover. In the event that InfiniteBlu Pool Service does not close your pool, a $100 return fee will apply.
POOL COVER REMOVAL TERMS & CONDITIONS: The removal of covers will include hosing off debris and immediate folding for storage on the owner’s premises. We cannot assume any responsibility for the tearing of any covers either due to winter damage or normal removal procedures. Pool pumped out and acid washed. Stains or discoloration removed by an application of full strength acid will be considered part of the pool coating and will not be the responsibility of InfiniteBlu Pool Service. InfiniteBlu Pool Service shall additionally open the pressure relief valves for hydrostatic water as the lowering of the water and the removal of debris permits, but shall not be responsible for pool movement due to ground water conditions. Customer shall provide for the dumping of debris and leaves within a reasonable distance of the pool. If permits or special pumping conditions are required, an additional charge will be made. The quoted prices are for a discharge rate of 360 G.P.M. within 200 feet of the deep end of the pool. Acid washing of plaster surfaces will cause mild etching of the plaster. We do not recommend acid washing in general for plaster, however, it is the only method to remove stains. All work will be performed in a professional manner, but there is no guarantee on any change in the appearance or physical characteristics of the plaster.
WEEKLY SERVICE TERMS & CONDITIONS: Customer is responsible to keep pool water at proper level. Chemical costs are NOT included in this contract and will be billed separately on a monthly basis. Contract prices apply to standard size pools. Larger pools, prices to be quoted. If customer’s chemicals are to be used, it is the customer’s responsibility to have chemicals left out at the filter area. If customer’s chemicals are locked up, InfiniteBlu Pool Service will automatically supply chemicals for an additional cost. Weekly service will begin immediately after pool opening. Any weekly service provided after the
prepaid contract ends will be billed at the contract rate at month’s end. Changes in this policy are up to customer discretion, however changes must be made in writing to InfiniteBlu Pool Service, no verbal changes are acceptable. If pools are equipped with a cartridge filter and the internal elements need cleaning, an additional fee will be charged to your monthly invoice. The average filter requires this service 1-2 times per season. In the event that a visit takes longer than 1 hour, additional labor charges will apply at $34 each additional 15 minutes, i.e. storm, hurricane, etc. Although all services will be provided in a professional workman-like manner, we cannot guarantee that your pool will not contract an algae bloom. Due to the nature of this type of service, we can only guarantee that your pool is spotless when the service is completed.
